General Terms and Conditions of Barkmate
Article 1 – General Provisions
These General Terms and Conditions govern the sale of products offered by Barkmate and the rights and obligations of the parties arising from agreements concluded between Barkmate and the consumer. Placing an order means acceptance of these terms.
Article 2 – Company Information
The seller is Barkmate, registered under the KvK number 94999767. You can contact the seller by email at: info@barkmate.com. Barkmate operates retail sales of dog products via an online store.
Article 3 – Scope of Application
These terms apply to all offers, orders, and sales agreements between Barkmate and the consumer, which refers to a natural person making a purchase unrelated to their professional or business activities. Before concluding the contract, the consumer has the opportunity to read these terms, and their acceptance is equivalent to the conclusion of the sales agreement. In case of discrepancies between these terms and specific provisions related to a particular product, the provisions more favourable to the consumer shall apply.
Article 4 – Offer and Conclusion of the Contract
All products offered by Barkmate are described in detail, allowing the customer to make an informed choice. Offers may be time-limited or subject to product availability. The sales agreement is concluded when the customer receives confirmation of the order. Barkmate reserves the right to refuse to fulfil an order if the information provided by the customer is incomplete or there are reasonable doubts regarding the ability to make payment.
Article 5 – Prices and Payment
All prices listed on the Barkmate website are gross prices in Australian dollars (AUD) and include VAT. Barkmate reserves the right to change prices in case of changes to tax regulations or shipping costs, but these changes do not affect orders already placed. Payment for products is made in advance unless otherwise agreed. The customer is required to provide correct payment details. If payment is not made within the specified time, the order may be suspended or cancelled.
Article 6 – Delivery and Order Fulfillment
Barkmate takes great care in fulfilling orders. Products are delivered to the address provided by the customer in the order form. The standard delivery time does not exceed 30 days, unless another date has been agreed. In case of delay, the customer will be promptly informed of the new delivery date and has the right to cancel the contract without additional costs. The risk of damage or loss of goods passes to the customer at the moment of receiving the shipment.
Article 7 – Right to Withdraw from the Agreement
The consumer has the right to withdraw from the distance contract within 14 days from the receipt of the product, without providing any reason. To exercise this right, the consumer must send a withdrawal statement to info@barkmate.com. The product must be returned in an unused condition, in its original packaging, no later than 14 days from the withdrawal notification. Barkmate will refund the customer all payments made within 14 days of receiving the returned product, using the same payment method used by the consumer. The right of withdrawal does not apply to products made to order or for hygienic reasons if the packaging has been opened upon delivery.
Article 8 – Complaints and Liability
Barkmate is responsible for ensuring that the product complies with the contract, in accordance with the Civil Code and the Consumer Rights Act. In case of product defects or non-compliance with the contract, the customer has the right to file a complaint. Complaints should be sent via email to info@barkmate.com, detailing the issue and including proof of purchase. Complaints are processed within 14 days of receipt. If the complaint is accepted, Barkmate will promptly exchange the product for a new one or refund the full amount.
Article 9 – Protection of Personal Data
Barkmate processes customer personal data in accordance with the GDPR (General Data Protection Regulation 2016/679). Personal data is used solely for order fulfillment, complaint handling, and customer communication. Barkmate does not share personal data with third parties without the customer’s consent, unless required by law.
Article 10 – Applicable Law and Dispute Resolution
All contracts concluded between Barkmate and the consumer are governed by Australian law. Any disputes arising from the sales contract or these terms will be resolved by the competent court in accordance with applicable Australian law.
Article 11 – Final Provisions
Barkmate reserves the right to make changes to these terms at any time, with the proviso that these changes do not affect rights acquired by consumers before their implementation. The current version of the General Terms and Conditions is always available on the Barkmate website. For matters not regulated by these terms, Australian law applies, including the Civil Code and Consumer Rights Act.
